A divorce, or “dissolution” in California, is not the only means to end a marriage. When a final judgment of legal separation is entered by the Court, parties no longer have the obligation to comply with marital rights and duties. The community property is divided and there is no accumulation of future community property or joint debt. Unless otherwise agreed to by the parties or ordered by the Court, there is no obligation for spousal support. Legally separated spouses cannot remarry. However certain benefits of marriage may be retained because the parties technically remain married in the eyes of the law.

Unlike dissolution of a marriage, there is no residency requirement to file for legal separation and a waiting period is not a precursor for obtaining a final judgment. Couples who do not meet the residency or jurisdictional requirements for divorce can file for legal separation and, upon satisfying residency requirements, may modify the petition into an action for dissolution.
