Divorce, separation, or a parentage action — however the custody question arises, Schoenberg Family Law Group, P.C. brings the same level of strategic, compassionate representation to each stage. We start by understanding the family in front of us, not by reaching for a standard template.
California law divides custody into two distinct categories: legal and physical.
Legal custody covers the authority to make major decisions about the child’s upbringing, such as school, healthcare, extracurriculars, and general welfare. Many Newport Beach cases end up with joint legal custody, meaning both parents retain that authority together. Sole legal custody is reserved for situations where shared decision-making genuinely isn’t workable or appropriate.
Physical custody determines where the child actually lives and how parenting time is split. Joint physical custody doesn’t demand an exact 50/50 division — it means both parents remain substantially involved in the child’s daily life. Sole physical custody, paired with visitation for the other parent, is a better fit in some family situations. Except in unusual circumstances, California courts favor both parents’ ongoing involvement, and consistent, meaningful time with the child.
Our attorneys walk clients through how these categories apply to their specific family and help build a parenting plan that protects the parent-child relationship while satisfying what the court requires.
Judges don’t award custody based simply on either parent’s wishes — the standard is always the child’s best interests. California Family Code § 3011 lays out the factors courts must weigh, including:
These factors are heavily fact-based, and involve details specific to Newport Beach family life, which means how your case is presented matters a great deal. A parent who shows up prepared, credible, and focused on the child rather than personal grievances is in a materially stronger position. We help clients navigate this important and emotionally-charged process with calm, clarity, and confidence. We protect parental rights while making your child’s well-being our first priority.
We represent parents throughout Newport Beach, Corona del Mar, Balboa Island, and Newport Coast across the full range of custody and visitation matters, including:
The skilled and compassionate team of attorneys at Schoenberg Family Law Group bring over 400 combined years of practice experience to your child-related legal matters. Founding attorney Debra Schoenberg, a Certified Family Law Specialist, has spent decades resolving some of the most sensitive custody disputes that come through Orange County courts. Her approach helps parents understand what’s genuinely at stake and present their case clearly, giving court professionals a compelling, stable picture of what’s best for the children involved.
Not every custody disagreement has to end up in a courtroom. California actively encourages parents – with their attorneys – to create their own tailored parenting plans for court approval. In contested custody cases, Orange County requires mediation through Family Court Services before a judge will issue final orders. When both parents are genuinely willing to work together, mediation offers real advantages:
Mediation sessions typically focus on building a workable parenting plan, setting custody and visitation terms, and reducing the ongoing friction between parents. For Newport Beach families, school schedules, sailing and club sports commitments, and long-standing community ties often shape a child’s routine in ways a judge simply doesn’t have the time to account for in detail.
That said, mediation isn’t right for every case. Serious safety concerns, a history of domestic violence, or a genuine breakdown in communication push a case toward litigation instead. In those situations, the Orange County Superior Court reviews evidence, hears testimony, and issues binding orders based on the child’s best interests. Our attorneys are skilled negotiators, well-versed in devising workable parenting plan solutions – but we are aggressive litigators when necessary. We help our clients navigate whatever path their case requires.
Custody arrangements aren’t set in stone. Kids grow, circumstances shift, and an order that made sense two years ago might not serve the child well today. California allows modifications when a parent can show a genuine, significant change in circumstances affecting the child’s welfare. Common reasons Newport Beach parents return to court include:
Judges look at whether the change is real and substantial, how a modification would affect the child’s stability, and whether it’s truly in the child’s interest rather than just more convenient for one parent. It’s essential to know that informal changes between parents, even ones both agree to, carry no legal weight unless the court formally approves them. We help clients get modifications properly documented so there’s no ambiguity later.
Custody work requires more than legal fluency. It takes an attorney who listens with compassion, understands the situation and the stakes, communicates clearly, and knows how to present a parent’s case credibly and persuasively. Nearly four decades of practice have shaped our track record of protecting both children’s well-being and parental rights.
Certified Family Law Specialist Debra Schoenberg leads with an approach that keeps personal conflict from overshadowing practical solutions. Her long history of creative custody resolutions, in and out of court, gives our team a real edge when building parenting plans judges are willing to approve. We approach both negotiation and trial with the same level of preparation, advocating for your parental rights while shielding your children from conflict and keeping their well-being front and center.

"I was seeking a reputable family law firm for my prenuptial agreement and received high praise for the Schoenberg Law Group. My attorney listened to my questions and responded to them very patiently. She also paid close attention all my concerns and made sure I was aware of the legal value of the agreement I was about to sign. It was…”
D.R.“It has been a real blessing to find this family law group in my life. I was in the middle of a custody battle with my ex wife and had a lawyer who had sided with my ex wife’s lawyer. I was faced with the option of paying to a regular lawyer to do half jobs with no results or to invest a bit more for a top family counselor who understood my situation and at the same time not giving me false hopes."
A.L."I hesitated filing papers for a long time because I was not sure if I could survive a long legal battle. When we were married, my husband worked while I raised the children, two under four years old, and I was afraid I would lose the stability they needed. I had a wonderful group of friends that helped me search for a reputable law firm that could represent me when my focus was on my children. They found the"
L.A.We are trial lawyers who litigate high-conflict, high-stakes cases. While we try to build on mediation efforts and exhaust opportunities for a negotiated agreement, emotions, egos and various other realities often force these disputes into court. Possibly. Support is based on each parent's income and their actual share of parenting time, not just the schedule split. A higher earner can still owe support even under equal time-sharing.
A judge may factor in a mature child's preference, typically around age 14 and up, but it's one consideration among several rather than the deciding factor. The court's focus stays on the child’s overall best interests.
File for contempt or request a modification. Orange County courts take violations very seriously and may adjust the arrangement in response to a consistent pattern of noncompliance.
Through a Voluntary Declaration of Parentage or a court order supported by DNA testing. Paternity has to be established before custody or child support can be requested.
It's when a custodial parent wants to relocate a significant distance with the child. The parent proposing the move has to show it genuinely serves the child's interests, not just their own preferences — and these cases tend to be contested.
Yes, if the parents' relationship has ended and the grandparent can show a meaningful existing bond with the child, which visitation would serve.
Temporary orders can move quickly. A final judgment often takes several months, longer if a custody evaluation gets ordered or the case is contested.
Yes, but only with proof of a significant change in circumstances. Courts intentionally set that bar high to maintain vital stability for children.
The court can require drug testing, order supervised visitation, or attach other conditions to protect the child. Documented substance abuse is taken seriously in these proceedings.
Everything relevant to the child's long-term welfare — physical safety, emotional stability, the strength of each parent relationship, and ties to their community, among other factors courts weigh case by case.
